Legal vs Illegal Drone Operators — What Clients Must Know

December 15, 2024 10 min read Riaan Huysamen

Hiring a drone operator isn't just about gear or skill — it's about legality and liability. Most clients don't realize that having a drone license (RPL) alone means nothing without a proper UASOC/ROC. Here's why that distinction matters.

The Misconception

Many drone operators proudly advertise their Remote Pilot License (RPL) — and while that's required, it's only a license to fly. It does NOT grant the legal right to conduct commercial operations.

What Makes a Drone Operation Legal?

UASOC/ROC

A valid Remote Operator Certificate (ROC) issued by SACAA allows legal commercial drone activity. This must be tied to a registered company.

Operating Specifications

Every UASOC/ROC comes with an official document listing the specific aircraft, pilot names, and areas of operation. This is your proof of legality.

Insurance, SOPs, and Compliance

Only ROC-certified operators & Pilots listed with them can carry legal drone liability insurance, operate near people/property, and meet airspace/legal requirements.

Red Flags for Clients

If you're a client hiring drone services, here's what you MUST ask for:

📄 A copy of the company's UASOC/ROC document
✅ Your pilot's name listed on the ROC's approved operators
✈️ The drone's registration number listed on the ROC operations spec

If they cannot provide this, you are working with an illegal operator — and YOU may be liable in case of incident. Fines from R10k to 100k and legal action.

Why It Matters

Illegal operators cut corners. They skip safety protocols, can't get proper insurance, and risk fines or even criminal charges. Your brand, budget, and people deserve better.

At Drone Pilot Cape Town, we fly under full legal UASOC/ROC authority — with listed pilots, aircraft, and a spotless flight record. Don't settle for "licensed" — demand legal.
